רשות ניירות הערך של קפריסין (CYSEC) פרסמה לאחרונה (27.11.15) הודעה על הטלת קנס בסך 340,000 אירו על חברת WGM Services Ltd, המעניקה שירותי השקעות ומפעילה זירת מסחר באופציות בינאריות, בשל ליקויים בתחום מניעת הלבנת הון ומימון טרור והפרות של תקנות הקשורות למתן שירותי השקעות ע"י חברות קפריסאיות.

בין היתר, צוין כי החברה לא הטמיעה מערכות והליכים נאותים בנוגע לזיהוי לקוחות ובדיקות נאותות ללקוחות. עוד נמסר, כי קצין הציות של החברה לא ביצע בקרה והערכה נאותה של מדיניות החברה והבקרות הפנימיות שלה בתחום מניעת הלבנת הון ומימון טרור.

נוסף על כך, צוין כי חלק מהקנס הוטל על החברה משום שהפרה את תנאי ההיתר שניתנו לה. בהקשר זה צוין בסעיפים B ו-L:

Β. €5.000 for non-compliance with Section 28(1) of L.144(Ι)/2007 as it failed to comply at all times with the authorization and operating conditions, as laid down in Section 16 of L.144(Ι)/2007 since, while its headquarters were in Cyprus, the Company’s operations were not in fact exercised from Cyprus, namely:
The management of the www.eztrader.com platform and the conclusion of
transactions in binary options, which constitutes the largest part of the Company’s
operations, were carried out from Israel, and
a number of persons managing the www.eztrader.com platform were established in Israel.

L. €5.000 for non-compliance with Section 76(2) of L.144(Ι)/2007 as, while providing
investment services from Israel through the www.ezinvest.com platform, through
persons established there for the management of the said platform, it failed to notify the Commission in writing of its intention to establish a branch there, as required.

בד בבד, ה-CYSEC ציינה בהודעתה כי במסגרת קבלת ההחלטה על הקנס שהוטל היא לקחה בחשבון את הפעולות שנקטה החברה לתיקון הליקויים, לרבות צעדים שנקטה החברה כדי להעביר את הנהלת הזירה www.eztrader.com לקפריסין.
